By accessing this website or purchasing products, you agree to be bound by these Terms and Conditions. If you do not agree to all terms, you are prohibited from using this site or purchasing items.

2. Limitation of Liability

To the maximum extent permitted by law, Motherlode Prospecting LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or equipment use, arising out of the use or inability to use our products. Our total liability for any claim shall not exceed the purchase price of the specific item that gave rise to the claim.

3. Product Warranty & Disclaimer

All products are sold "As Is" and "With All Faults." Motherlode Prospecting LLC makes no warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose unless explicitly stated in the item description. Technical advice or repair guidance provided by this site is for informational purposes only; users assume all risk for modifications or repairs.

4. Shipping & Risk of Loss

All items are shipped FOB Shipping Point. This means the risk of loss and title for such items pass to you upon our delivery to the carrier. We are not responsible for delays, damage, or loss caused by the shipping provider.

5. Pricing & Availability

We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product availability. Prices are subject to change without notice.

6. User Conduct & Intellectual Property

All content on this site, including text, images, and logos, is the property of Motherlode Prospecting LLC. Unauthorized use, reproduction, or distribution is strictly prohibited.

7. Governing Law

These terms are governed by the laws of the State of California. Any legal action or proceeding relating to your access to, or use of, the site shall be instituted in a state or federal court in Calaveras County, California.

8. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Return and Refund Policy

Returns & Eligibility

Returns are accepted only within 14 days of delivery. To be eligible, items must be in their original, unopened packaging, unused, and in the same condition as received. Proof of purchase is required.

Non-Returnable Items

The following items are strictly non-returnable:

Used or field-tested equipment.
Custom-made or personalized products.
Items marked "Final Sale" or "Clearance."
Downloadable software or digital products.

Shipping & Fees

The customer is responsible for all return shipping costs and assumes all risk of loss or damage during transit. A 20% restocking fee will be deducted from all approved refunds to cover administrative and processing costs. Original shipping charges are non-refundable.

Refund Process

Refunds are issued to the original payment method only after the item has been inspected and approved. If an item is returned in a condition that prevents it from being sold as new, the return will be rejected, and the item will be sent back at the customer's expense.
